Terms of Use

These Terms of Use ("Terms of Use") set out the rules for accessing and using the Nanus Gold Rate application and the website at https://nanusgoldrateapp.com (together, the "Service"), operated by Nanus Technologies Private Limited ("Nanus", "we", "us", "our").

They work alongside our Terms and Conditions (which govern the commercial relationship, including subscriptions and payments) and our User-Generated Content Policy (which governs the content you create). Where the Terms and Conditions and these Terms of Use conflict on a commercial matter, the Terms and Conditions prevail.

By using the Service, you agree to follow these Terms of Use.

1. Your Account

1.1. You are responsible for everything done through your Account. Keep your login details secure and notify us promptly at support@nanustechnologies.com if you suspect unauthorised use.

1.2. Provide accurate business and profile information, and keep it current. You must not impersonate another business, person, or brand, or misrepresent your affiliation with anyone.

1.3. One person or business should not maintain multiple accounts to abuse trials, offers, referrals, or rewards.

2. Permitted Use

2.1. You may use the Service only for lawful purposes connected with operating and promoting a genuine jewellery, gold, silver, or bullion business, and in accordance with these Terms of Use.

2.2. The posters, creatives, and profile material you produce are licensed to you for promoting your own business, as described in the Terms and Conditions. You must not resell or redistribute the app's templates or design assets as stand-alone products.

3. Prohibited Conduct

You must not, and must not permit anyone else to:

3.1. Use the Service in any way that breaches any applicable law or regulation, including consumer-protection, advertising, hallmarking, weights-and-measures, and precious-metals regulations that apply to your business.

3.2. Publish or share false, misleading, or deceptive gold/silver rates, offers, discounts, or business claims, or use the Service to defraud or mislead customers.

3.3. Upload or share content that is unlawful, infringing, defamatory, obscene, hateful, harassing, or that violates our User-Generated Content Policy.

3.4. Infringe anyone's intellectual-property, privacy, or other rights — including using logos, trademarks, photographs, or designs you are not authorised to use.

3.5. Upload viruses, malware, or any code designed to harm, disrupt, or gain unauthorised access to the Service or to other users.

3.6. Attempt to probe, scan, hack, reverse-engineer, decompile, or circumvent any security, access-control, or licensing measure of the Service, except to the extent such restriction is prohibited by law.

3.7. Access the Service through automated means (bots, scrapers, crawlers) or collect data about other users without our written permission.

3.8. Overload, disrupt, or interfere with the Service, its servers, or networks, or take any action that imposes an unreasonable load on our infrastructure.

3.9. Resell, sublicense, rent, or commercially exploit the Service or any part of it except as expressly permitted.

3.10. Use the Service to send spam, or unsolicited or unlawful communications, or to harvest contact details for such purposes.

3.11. Misuse the marketplace, advertisement, referral, or rewards features — including posting fake listings, manipulating referrals, or engaging in fraudulent or abusive activity.

4. User Content

Any content you create, upload, or share through the Service — including logos, business details, photographs, taglines, posters, listings, and advertisements — is governed by our User-Generated Content Policy. You are solely responsible for your content and must have all rights necessary to use it.

5. Gold Rates — Information Only

Rates and other informational content in the Service are indicative only and may be delayed or inaccurate. They are not advice or an offer, and you must not rely on them without independent verification. See Section 4 of the Terms and Conditions for details. You are responsible for any rates you choose to publish to your customers.

6. Availability and Changes

6.1. We aim to keep the Service available but do not guarantee uninterrupted access. The Service may be unavailable during maintenance, updates, or for reasons beyond our control.

6.2. We may modify, suspend, or discontinue any part of the Service at any time, as described in the Terms and Conditions.

7. Intellectual Property

The Service and its content (other than your User Content) belong to Nanus or its licensors and are protected by law. Your limited licence to use the Service is set out in the Terms and Conditions. Do not remove or alter any copyright, trademark, or proprietary notice.

8. Links and Third-Party Platforms

The Service may link to third-party sites and platforms (such as WhatsApp, Instagram, Facebook, and the App Stores). We do not control and are not responsible for third-party platforms, and your use of them is subject to their own terms.

9. Suspension for Breach

If you breach these Terms of Use, we may warn you, remove content, restrict features, or suspend or terminate your Account, with or without notice, as described in the Terms and Conditions. We may also report unlawful activity to the relevant authorities.

10. Disclaimers and Liability

Your use of the Service is at your own risk. The disclaimers and limitations of liability in Sections 13 and 14 of the Terms and Conditions apply to these Terms of Use and are incorporated here by reference.

11. Changes to These Terms of Use

We may update these Terms of Use from time to time. We will update the "Last updated" date, and material changes may be notified in the app. Continued use of the Service after changes take effect means you accept the revised Terms of Use.

12. Governing Law

These Terms of Use are governed by the laws of India, and disputes are subject to the jurisdiction described in Section 18 of the Terms and Conditions.
